Article 1 – Definitions

In these terms, the following definitions apply.

The cooling-off period refers to the time during which the consumer may exercise the right of withdrawal.

A consumer is a natural person acting outside the scope of any business or professional activity.

A day refers to a calendar day.

An ongoing contract is a contract that involves regular deliveries over a period of time.

A durable data carrier refers to a tool that enables information to be stored unchanged for future reference.

The right of withdrawal refers to the right to terminate the agreement within the cooling-off period.

The company or merchant refers to the legal entity selling products or services at a distance.

A distance contract is an agreement concluded without physical presence.

Means of distance communication are methods used to enter into agreements without physical presence.

Article 3 – Applicability

These terms apply to all offers, distance contracts and transactions between the consumer and Luminizing.

The terms are made available before the purchase is completed. For electronic purchases, they can be downloaded onto a durable data carrier.

If any provision contradicts consumer protection laws, the most consumer-friendly rule applies.

Article 4 – Offer

If an offer is time-limited, this will be clearly stated.

All product descriptions and images are intended to represent the product as accurately as possible.

The offer always contains clear information about the price, any shipping costs, payment methods, delivery, the right of withdrawal, and, in the case of subscriptions, the duration of the contract.

Article 5 – The Agreement

The agreement is concluded once the consumer submits an order and receives an order confirmation by email.

Luminizing ensures a secure payment environment.

The company may refuse orders in cases of suspected fraud or payment issues.

After purchase, the consumer receives all relevant information, including contact details, withdrawal rights, guarantees and these terms.

Article 6 – Right of Withdrawal

The consumer has 14 days to withdraw from the purchase, starting from the day the product is received.

Products may only be handled to the extent necessary to determine their nature, characteristics and functioning.

A notice of withdrawal must be sent by email within 14 days, and the product must be returned within the following 14 days.

If the company does not receive a valid withdrawal notice or return in time, the purchase becomes binding.

Article 7 – Costs in Case of Withdrawal

Return shipping costs are paid by the consumer.

Once a valid return is received, the refund will be issued within 14 days, provided the product has been received or the consumer provides proof of shipment.

Article 8 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to custom-made products, personalised products, hygiene items with a broken seal, products that deteriorate quickly, or digital content delivered immediately after explicit consent.

Article 9 – Prices

Prices will not be changed during the validity period of the offer, except when required by changes in legislation.

Products ship from outside the EU and may incur import VAT or customs duties, which must be paid by the recipient.

Typographical errors are reserved.

Article 10 – Warranty and Complaints

Products must meet the agreed quality standards.

Defects must be reported in writing within 14 days of receipt.

Warranty does not apply to defects caused by improper use, unauthorised repairs or external damage.

Article 11 – Delivery

Orders are processed with care and shipped to the address provided by the consumer.

If delays occur, the consumer will be notified within 30 days and may cancel the order at no cost.

If a product cannot be delivered, a replacement may be sent. The right of withdrawal still applies.

Risk transfers to the consumer upon receipt.

Article 12 – Ongoing Contracts

The consumer may terminate subscription contracts with a maximum notice period of one month.

Fixed-term contracts are not automatically renewed without the consumer’s explicit consent.

Article 13 – Payment

Payment must be made according to the options provided at checkout.

The consumer must correct any incorrect payment information immediately.

If payment is not made, the company may charge reasonable collection costs.

Article 14 – Complaints

Complaints must be submitted to info@luminizing.de within 7 days after the issue is discovered.

A response will be provided within 14 days. If more time is needed, the consumer will be informed.

Article 15 – Disputes

Swedish law applies.

If necessary, the consumer may contact the Swedish National Board for Consumer Disputes (ARN).

Article 16 – CESOP

Payments may be reported to the EU’s central payment reporting system (CESOP) in accordance with applicable regulations.
